About this policy


MenoCraft Health Coaching is operated by Gina Knight, a sole trader based in Perth, Western Australia. In this policy, “we”, “us” and “our” mean MenoCraft Health Coaching, and “you” means anyone who visits www.menocraft.com.au, contacts us, or uses our coaching services.


Your privacy matters to us, especially because our conversations about your health are personal. This policy explains what personal information we collect, why we collect it, how we look after it, and the choices you have. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because we provide a health-related service, we treat ourselves as fully covered by the Privacy Act, regardless of the size of our business.


A quick note on our services: MenoCraft provides health coaching. Gina is an Accredited PREKURE Health Coach and a Professional Member of HCANZA and the Australasian Metabolic Health Society, but is not a medical, dietetic or allied health practitioner and does not diagnose, treat or prescribe. Nothing on our website or in our sessions is medical advice.


What personal information we collect


We only collect information that we reasonably need to provide our services and run our business. Depending on how you interact with us, this may include:


  • Contact details: your name, email address, phone number and general location (for example, your city or whether you are in Australia or New Zealand).
  • Booking information: appointment dates and times, the type of session (online by video call, or face to face in Perth for Bloom clients where negotiated), and any messages you send us when booking.
  • Health and lifestyle information: information you choose to share in intake forms and during sessions, such as your perimenopause or menopause symptoms, medical history, medications, eating patterns, sleep, activity, stress, and other details relevant to your wellbeing. This is “sensitive information” under the Privacy Act and we give it extra protection.
  • Coaching records: your goals, session notes and progress notes.
  • Payment information: records of what you have paid and when. Card details are entered directly with our third-party payment provider and are not stored by us.
  • Marketing preferences: your email address and name if you sign up to our newsletter or request one of our free e-books or resources.
  • Website information: technical information collected through cookies and analytics tools, such as your device and browser type, pages visited and approximate location (see “Cookies and analytics” below).


How we collect your information


Wherever possible, we collect personal information directly from you, for example when you:


  • fill in a contact, booking or intake form;
  • book a discovery call or coaching session;
  • talk with us in a session, by email, phone or message;
  • sign up for our newsletter or free e-book; or
  • browse our website (through cookies and analytics).


Occasionally we may receive information from someone else, such as a person who refers you to us, or a health professional you ask to share information with us. We will only do this with your knowledge.


Why we collect and use your information


We collect, hold and use your personal information to:


  • respond to your enquiries and book and manage your sessions;
  • provide safe, personalised health coaching that suits your circumstances and goals;
  • keep accurate coaching records and track your progress;
  • process payments and keep financial records;
  • send you your free e-book and, if you have agreed, our newsletter and occasional updates;
  • understand how our website is used so we can improve it; and
  • meet our legal, insurance and professional obligations.


We will only use or disclose your information for the purpose we collected it, for a related purpose you would reasonably expect (or, for health information, a directly related purpose), with your consent, or where the law requires or allows it.


Your consent to collect health information


We will only collect health information about you with your consent and where it is reasonably necessary for our coaching services. When you complete our intake form or share health information in a session, we will ask for your consent and explain why we need it. You can choose not to share particular details, but this may limit how well we can tailor our coaching to you. You may withdraw your consent at any time by contacting us, although we may still need to keep certain records for legal reasons (see “How long we keep your information”).


Staying anonymous or using a pseudonym


You are welcome to browse our website and ask general questions without telling us who you are, or by using a different name. However, we need your real name and contact details to book sessions, take payments and provide personalised coaching, so it is generally not practical to provide coaching services anonymously.


Who we share your information with


We do not sell, rent or trade your personal information. We share it only where needed to run our business, with trusted service providers such as:


  • our website host (our site is built on the Articulation website platform);
  • booking and scheduling providers;
  • payment providers;
  • email and file storage providers (such as Google Workspace or Gmail);
  • video call platforms (such as Zoom or Google Meet); and
  • analytics providers (such as Google Analytics).


These providers only receive the information they need to perform their service. We may also disclose information:


  • to our professional indemnity insurer, or legal advisers, if this is needed in connection with a claim or potential claim;
  • to a health professional or other person, if you ask us to;
  • where we reasonably believe it is necessary to lessen or prevent a serious threat to someone’s life, health or safety; or
  • where required or authorised by law.


Sending information overseas


Some of the service providers we use store or process information on servers outside Australia. Most commonly this is in the United States, where many cloud-based email, booking, video call and analytics services are based. Depending on the provider, information may also be stored in other countries where they or their sub-contractors operate. If you are a client in New Zealand, information you share with us will be held in Australia and with these providers.


We take reasonable steps to ensure overseas providers handle personal information consistently with the Australian Privacy Principles, for example by choosing reputable providers with strong security and privacy commitments.


Marketing emails and your free e-book


If you request one of our free e-books or resources, or sign up to our newsletter, we will add you to our email list with your consent. In line with the Spam Act 2003 (Cth), every marketing email we send will clearly identify us and include an easy way to unsubscribe. You can opt out at any time by clicking “unsubscribe” or letting us know through our website contact form, and we will action your request within five working days. Unsubscribing from marketing will not affect emails about sessions you have booked.


We will never use the health information you share in coaching for marketing, and we never pass your details to anyone else for their marketing.


Cookies and analytics


Cookies are small files placed on your device when you visit a website. Our website uses:


  • Essential cookies, which the site needs to work properly and securely, such as remembering your cookie preferences. These cannot be switched off through our site.
  • Analytics cookies, such as Google Analytics, which help us understand how visitors find and use our site (for example, which pages are popular). This information is generally collected in aggregate and does not identify you by name.


When you first visit, our website displays a cookie notice. You can also manage or delete cookies through your browser settings, and you can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on (available at tools.google.com/dlpage/gaoptout). Blocking some cookies may affect how the site works.


Automated decision-making


We do not use computer programs, algorithms or artificial intelligence to make decisions about you that could significantly affect your rights or interests. All coaching input is provided by a person, not by automated systems or AI. If this ever changes, we will update this policy to explain what information is used and what kinds of decisions are involved, as required by the Privacy Act.


How we store and protect your information


We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, change or disclosure. These steps include:


  • storing records in secure, password-protected cloud systems with two-factor authentication where available;
  • keeping any paper records in a locked, secure place;
  • limiting access to your information to Gina, or to providers only as needed; and
  • using reputable providers that encrypt information and keep their systems up to date.


No online system is completely secure, but we work hard to keep your information safe.


How long we keep your information


Western Australia does not have a specific health records law for private-sector providers. In line with common Australian health record guidance, we keep client coaching records, including health information, for seven years after our last contact with you. We keep financial records for as long as tax law requires. After that, or once information is no longer needed, we securely destroy it or permanently de-identify it. If you unsubscribe from our emails, we remove you from our mailing list but may keep a record that you have opted out so we don’t contact you again.


Accessing and correcting your information


You can ask to see the personal information we hold about you, and ask us to correct anything that is inaccurate, out of date, incomplete or misleading. Just contact us using the details below. We will need to confirm your identity first. We will respond within a reasonable time, usually within 30 days, and there is no charge to make a request. In rare cases the law allows us to refuse access (for example, where it would unreasonably affect someone else’s privacy). If we refuse, we will explain why in writing and tell you how to complain.


If there is a data breach


If a data breach happens that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme, and take steps to contain the breach and reduce any harm. For New Zealand clients, we will also notify the New Zealand Office of the Privacy Commissioner where required.


Clients in New Zealand


If you are in New Zealand, we also handle your personal information in line with the New Zealand Privacy Act 2020 and its Information Privacy Principles. You have the right to access and request correction of your information, and we will respond within 20 working days. If you are unhappy with how we have handled a privacy matter, please contact us first. You can also complain to the Office of the Privacy Commissioner at privacy.org.nz.


Visitors from the United Kingdom and European Union


Our services are mainly for people in Australia and New Zealand. Where the UK or EU General Data Protection Regulation (GDPR) applies, we rely on these legal bases: your consent (including your explicit consent for health information and marketing), the need to provide services you have asked for, our legitimate interests in running and improving our business, and compliance with legal obligations. You may have the right to access, correct, delete, restrict or object to the use of your information, to receive a copy of it in a portable format, and to withdraw consent at any time. You can also complain to your local data protection authority (in the UK, the Information Commissioner’s Office).


Children


Our website and services are intended for adults aged 18 and over. We do not knowingly collect personal information from children. If you believe a child has given us their information, please contact us and we will delete it.


Links to other websites


Our website may link to other websites, such as social media or booking platforms. We are not responsible for their privacy practices.


Questions and complaints


If you have a privacy question or concern, please contact us first so we can try to put things right. We will acknowledge your complaint promptly and aim to respond within 30 days.


If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992. New Zealand clients can contact the Office of the Privacy Commissioner at privacy.org.nz. Australian law also gives individuals the right to take legal action for serious invasions of privacy.


Changes to this policy


We may update this policy from time to time, for example to reflect changes in the law. The latest version will always be on our website.
